Terms
1. Who we are
Trofeo Overlays is provided by OnePromise GmbH, Güterstrasse 213, 4053 Basel, Switzerland ("we"), based in Switzerland.
2. What you get
A subscription gives you a licence to use the Trofeo Overlays app for Windows with iRacing, including updates released during the subscription. The licence is personal and not transferable.
3. Plans and prices
Monthly: $5.99 per month. Yearly: $49 per year. Prices are in USD and include any sales tax or VAT that applies where you live.
4. Free trial
Every plan starts with a 7-day free trial. One free trial per customer. If you had one before, the first payment is taken right away. If you do not cancel before the trial ends, your subscription starts and you are charged for the plan you chose.
5. Renewal
Your subscription renews automatically for the same period (a month or a year) at the then-current price until you cancel.
6. Cancelling
You can cancel at any time in the customer portal. Cancelling takes effect at the end of the current billing period; you keep using the app until then. Refunds are covered on the refunds page.
7. Licence key and devices
Your licence key is shown in your account (the customer portal); Polar's email links to it. One key may be used on 2 PCs. Do not share, sell or publish your key. We may block a key that is used beyond that.
8. Payment provider
Polar is the merchant of record. It handles payment, invoices, taxes and refunds, and its own terms apply to the payment: Polar Buyer Terms.
9. No affiliation with iRacing
Trofeo Overlays is not affiliated with or endorsed by iRacing.com Motorsport Simulations, LLC. You are responsible for using the app in line with iRacing's own terms.
10. Warranty and liability
We are liable as the law requires. Where the law allows, our liability for slight negligence is limited, and your mandatory consumer rights stay untouched. We do not promise that the app runs without interruption or works with every iRacing update on the day it comes out; we fix faults within a reasonable time. Our liability for intent and gross negligence, and for harm to life, body or health, is never limited.
11. Changes
We may update these terms and the price for future billing periods. We will tell you before a change takes effect. We announce a change by email at least 30 days before it takes effect. If you do not agree, you can cancel before then; if you keep your subscription, the new terms apply from that date. A new price applies only from your next billing period.
12. Governing law and jurisdiction
Swiss law applies, excluding its conflict-of-laws rules and the UN Sales Convention. Place of jurisdiction: Basel, Switzerland. Mandatory consumer protection rules of the country where you live stay in place.
